  • Productivity coaching is a partnership (defined as an alliance, not a legal business partnership) between the coach and the client in a thought-provoking and introspective process that inspires the client to maximize their productivity. It is designed to facilitate the creation/development of personal or professional goals and to develop and carry out a strategy/plan for achieving those goals that are in direct relation to their productivity.
  • The client and coach agree to engage fully in the coaching experience.
  • Productivity coaching sessions will be held once per week at a mutually agreed-upon time and date. Each coaching session will be a minimum of 45 minutes and a maximum of two hours in length unless otherwise agreed upon by both parties. The fee for coaching services will remain the same regardless of the duration of the coaching session.
  • The coaching sessions shall be ongoing until either the coach or the client decides to terminate the agreement. The coach and the client shall discuss and agree upon the frequency and duration of coaching sessions at the beginning of the coaching relationship.
  • The frequency of coaching sessions may only be altered with mutual agreement and prior discussion between the coach and the client.
  • Productivity coaching is not a substitute for professional counseling or therapy. The coach is not a licensed therapist and cannot provide medical or mental health advice. The client should not rely solely on the coach’s advice and should seek additional professional support as needed.
  • The coach does not provide legal or financial advice. The client may need to consult with the appropriate professionals in these areas as needed.
  • The coach’s coaching services are not a substitute for other personal or professional development forms, and the client may need to pursue additional training or education to achieve their goals.
  • The client understands and acknowledges that the coach’s services come from years of lived experience, personal research, and the cumulative insights the coach had while working with his clients.
  • The coaching sessions with the client are private, but the coach may share de-identified information with a supervisor or mentor to improve their coaching services.
  • The coach may disclose the content from coaching sessions with the client to law enforcement agencies or other relevant authorities if required by law or in case of any investigation.
  • The client acknowledges that the coach has developed and/or acquired valuable intellectual property and proprietary information, including but not limited to coaching methods, techniques, processes, strategies, and materials, and that such information constitutes confidential information of the coach. The client agrees to keep all such information confidential and not to disclose it to any third party without the express written consent of the coach unless required by law.
  • The coach may use various tools and assessments to help the client gain insight into their productivity challenges, but the client is ultimately responsible for implementing any changes or strategies recommended by the coach.
  • The coach may use case studies, examples, or stories from their experience to illustrate coaching concepts, but the client understands that these are not necessarily representative of their situation.
  • The coach may recommend resources such as books, articles, or online courses to supplement coaching sessions, but the client is responsible for evaluating and implementing these resources independently.
  • By participating in coaching, the client acknowledges and agrees to the use of certain third-party tools and services to facilitate coaching, communication, document creation, and document sharing.
  • It is essential to understand that while the coach takes every reasonable measure to protect the client’s data and ensure the security and confidentiality of coaching sessions, document creation, and document sharing, the use of third-party tools involves risks beyond the coach’s control.
  • The Client acknowledges and agrees to the terms of service and privacy policies of the companies providing the third-party tools and services used throughout the coaching relationship. The Client understands that any breaches in privacy or data mishandling arising from the practices of these companies are beyond the control and responsibility of The Coach.
  • By proceeding with participating in coaching, The Client absolves The Coach of any liability related to privacy breaches or data mishandling by these third-party service providers.
  • The client is responsible for maintaining the security of their accounts, personal information, and credentials associated with these third-party tools.
  • Coaching is a collaborative process, and the client’s success depends on their willingness to participate fully in the coaching process.
  • Coaching is not a substitute for personal responsibility; the client is ultimately responsible for their own success and well-being.
  • The coach cannot guarantee specific outcomes. The client is responsible for their own decisions and actions.
  • The client agrees that they are proceeding with coaching sessions at their own risk and that the coach will not be held responsible or liable for any negative outcomes resulting from their participation in coaching. The client releases the coach and its agents, affiliates, employees, contractors, and successors from any and all claims, demands, damages, actions, or causes of action arising out of or in any way connected with their participation in coaching sessions.
  • The client may cancel or reschedule their appointment up to 48 hours before the scheduled time. For example, if the appointment is on Saturday at 9 am, the client has until 9 am on Thursday to cancel or reschedule the appointment.
  • If either the client or the coach is late for a scheduled coaching session by more than 15 minutes, the session will be considered missed by the late party, and the other party will not be required to wait. In the event that the coach is late, the coach will extend the session by the amount of time that was missed. However, if the client is late, the session will still end at the originally scheduled time, and the client will be responsible for the full fee of the session.
  • If the coach cannot attend the session, the subsequent two sessions will be provided free of charge. However, if the client misses the scheduled session, they will be responsible for paying 50% of the session’s rate. Failure to comply with this policy may result in the termination of the working relationship between the coach and the client.
  • If an emergency arises during a coaching session, either the coach or the client has the right to terminate the session at any time. In such a case, the session will be free of charge.
  • The client must make all payments for the coaching services exclusively through PayPal. At the end of the coaching session, the coach can provide the client with the coach’s PayPal account information to facilitate payment. 
  • Refunds are only possible in the case of a prior advance payment for a set number of sessions that are not used. If the client has made an advance payment and the total number of sessions they receive is less than the number paid for, they are entitled to a partial refund for the unused sessions. However, any request for a partial refund must be made within three months of the date of the last session conducted between the coach and the client. After three months, the client will no longer be entitled to a partial refund.
  • The coach is not obligated to refund any fees paid by the client for the sessions they already had.
  • Any dispute, controversy or claim arising out of or in connection with this coaching agreement or the breach, termination or invalidity thereof, shall be resolved by negotiation between the parties in good faith. If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to mediation, which shall be conducted by a mediator agreed upon by the parties.
  • Either party may terminate this coaching agreement at any time for any reason. 
  • The coach may terminate the coaching relationship immediately without notice if the client engages in any conduct that is unethical, illegal, or in violation of the coach’s code of ethics.
  • The client represents and warrants that they are over the age of 18 and are not under any legal disability that would require the consent or supervision of a legal guardian in order to enter into and perform the obligations under this Agreement.
  • The client acknowledges having reviewed, understood, and agreed to all the terms and conditions outlined in this Coaching Service Agreement.
